3.1 Submitting a Listing

When you submit a business listing to the Site, you represent and warrant that:

• You are authorized to submit information on behalf of the business
• All information provided is accurate, current, and not misleading
• The listing does not violate any applicable laws, third-party rights, or these Terms

OurTownGuide.com reserves the right to review, approve, reject, edit, or remove any listing at its sole discretion, without notice or liability.

3.2 Listing Accuracy

We make no guarantee that business listings on the Site are accurate, complete, or up to date. Listings are provided as a community resource and may be submitted by business owners, third parties, or aggregated from public sources. It is the responsibility of each business to ensure its listing information is current. To update or correct a listing, contact us at

3.3 Featured & Premium Listings

We may offer paid placement, featured listings, or enhanced profiles. Payment terms for these services will be communicated at the time of purchase. Fees are non-refundable unless otherwise stated. We reserve the right to modify pricing at any time with reasonable notice.

4. User Accounts

If you create an account on the Site, you are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use of your account

Notify us immediately at support@ourtownguide.com if you suspect unauthorized access. We are not liable for any loss resulting from unauthorized use of your account.

5. Intellectual Property

Where the Site permits user reviews or ratings of businesses, such content represents the opinions of individual users and does not reflect the views of OurTownGuide.com. We do not verify the accuracy of reviews.

By submitting a review, you agree that it is honest, based on your genuine experience, and complies with these Terms. Reviews that are fraudulent, defamatory, or submitted in bad faith may be removed at our discretion.

Businesses must not solicit fake reviews or attempt to manipulate ratings. Violation of this policy may result in listing suspension or removal.

9. Privacy

OURTOWNGUIDE.COM EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

• The Site will be uninterrupted, error-free, or secure
• Any listing information is accurate, complete, or current
• The Site will be free from viruses or other harmful components
• Results obtained from use of the Site will be accurate or reliable

Your use of the Site is at your sole risk.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OURTOWNGUIDE.COM, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Unauthorized access to or alteration of your data
• Any conduct or content of third parties on or linked from the Site

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO OURTOWNGUIDE.COM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless OurTownGuide.com, its owners, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

• Your use of or inability to use the Site
• Your violation of these Terms
• Your submission of inaccurate or unauthorized content
• Your infringement of any third-party rights

13. Copyright Complaints (DMCA)

If you believe that content on the Site infringes your copyright, please send a written notice to us at

• Identification of the copyrighted work you claim has been infringed
• Identification of the material on the Site you claim is infringing, with sufficient detail for us to locate it

Upon termination, all rights granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — shall remain in effect.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which OurTownGuide.com operates, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration or, where arbitration is not enforceable, to the exclusive jurisdiction of the courts in the applicable venue.

17. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Site.
